Safety Tips for Surfing

Indemnity and Waiver of Liability

I, the undersigned, hereby acknowledge and accept that participation in any activities, lessons, or services provided by Cape Town Surf School (Pty) Ltd involves inherent risks, including but not limited to injury, loss, or damage.

I understand and accept that the ocean is a dynamic and unpredictable environment, and that weather and surf conditions can change suddenly, potentially creating dangerous situations beyond the control of instructors or staff. These risks include, but are not limited to, strong currents, large waves, marine life, and rapidly shifting weather.

I confirm that I am able to swim confidently and unaided in open water. I further declare that I have no medical conditions, injuries, or physical limitations that could affect my ability to safely participate in a surfing lesson, or that may be aggravated by such participation. Should any such condition exist, I undertake to disclose it to Cape Town Surf School (Pty) Ltd in writing prior to taking part in any activities.

I acknowledge that the surf instructors have the authority to modify, postpone, or terminate a lesson at any time should they deem conditions to be unsafe or unsuitable. I accept that such decisions are made in the interest of safety for all participants.

I understand and agree that the use of narcotics, or being under the influence of any narcotic substances, either before or during any surfing lesson, is strictly prohibited. Any breach of this condition may result in immediate termination of the lesson without refund and may result in exclusion from future participation.

I acknowledge that while Cape Town Surf School (Pty) Ltd aims to provide qualified and experienced instructors, not all surf coaches currently hold formal accreditation, as some are on the waiting list to complete their final certification course. I accept this as part of my voluntary participation.

In the event of a medical emergency, I hereby grant permission to Cape Town Surf School (Pty) Ltd, its staff, or instructors to contact emergency services and arrange for medical assistance (including ambulance transport) on my behalf. I understand that any such action will be taken in good faith and in the best interest of safety. I agree to take full financial responsibility for any and all medical or emergency-related costs incurred.

For Adults Accompanying a Minor Who Is Not Their Own Child

If I am bringing a minor who is not my biological or legally adopted child, I confirm that I have received permission from the child’s parent or legal guardian to act on their behalf. I confirm that I am authorised to:

Consent to the child’s participation in activities provided by Cape Town Surf School (Pty) Ltd

Acknowledge and accept all associated risks on behalf of the child

Consent to emergency medical treatment for the child if necessary

Accept responsibility for any medical or emergency costs incurred on behalf of the child

I agree to indemnify and hold harmless Cape Town Surf School (Pty) Ltd, its directors, employees, contractors, and agents from any and all claims, disputes, or liabilities arising from the participation of the minor in the activity, including any disputes relating to my authority to act on the child’s behalf.

Surf Package Clause

I understand and agree that if I book a surf package comprising multiple lessons (e.g., 3, 5, or 8 lessons), the indemnity and waiver form that I complete and submit prior to my first lesson will cover all subsequent lessons within that package. I acknowledge that I will not be required to complete a separate indemnity form for each individual lesson within the package.

Declaration

I voluntarily assume all risks associated with participation and agree to indemnify and hold harmless Cape Town Surf School (Pty) Ltd, its directors, employees, contractors, and agents from any and all claims, liabilities, demands, actions, or causes of action arising out of or in connection with my participation (or the participation of any minor in my care), whether caused by negligence or otherwise.

I confirm that I will not hold Cape Town Surf School (Pty) Ltd liable for any injury, loss, or damage sustained during or as a result of participation in its activities.
